1. Acceptance of Terms

By accessing or using the Music Saves Lives platform (the "Service"), including creating an account, participating in causes, making donations, redeeming rewards, or any other interaction with our website or mobile application (iOS and Android), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, registered users, volunteers, advocates, staff members, and any other individuals who access or use the Service. Music Saves Lives reserves the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

To use the Service, you must:

• Be at least 13 years of age. Users between 13 and 17 must have parental or guardian consent.
• Provide accurate, current, and complete information during registration.
• Not have been previously suspended or removed from the Service.
• Comply with all applicable local, state, national, and international laws and regulations.

3. Account Registration & Security

When you create an account, you agree to provide truthful information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Music Saves Lives uses a secure, email-based authentication system. You agree to:

• Notify us immediately of any unauthorized use of your account.
• Not share your login credentials with others.
• Not create accounts on behalf of other individuals without their consent.
• Maintain accurate profile information, including name, email, address, and date of birth where required.

Music Saves Lives reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Use of the Service

The Service is designed to facilitate lifesaving health activities and community engagement. You agree to use the Service only for lawful purposes and in a manner consistent with its mission. You may not:

• Submit false, misleading, or fraudulent proof of donation or participation.
• Attempt to manipulate the points system or claim rewards you have not legitimately earned.
• Use the Service to harass, threaten, or harm others.
• Scrape, copy, or redistribute any content or data from the Service without written permission.
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.
• Use automated bots, scripts, or other tools to interact with the Service.
• Impersonate any person, organization, or entity.
• Attempt to scan, redeem, or duplicate passes or vouchers fraudulently.

5. Points, Rewards & EXPERIENCE Vouchers

The Music Saves Lives Points program allows registered users to earn points by completing verified cause participations and quizzes, and redeem them for rewards, including VIP vouchers, merchandise, gift cards, and experiences. The following terms apply:

• Points have no monetary value and cannot be exchanged for cash or transferred between accounts.
• Points are awarded at Music Saves Lives' sole discretion and are subject to verification of the underlying activity.
• Rewards may be subject to availability, expiration dates, usage limits, and quantity restrictions as described on each reward listing.
• EXPERIENCE vouchers (gold and red tiers) are single-use, non-transferable, and must be presented with a valid government-issued ID at the event.
• VIP passes and redeemed perks may be scanned by Music Saves Lives staff or authorized partner scanners at events for redemption verification.
• Music Saves Lives reserves the right to modify, suspend, or terminate the rewards program at any time without notice.
• Any fraudulent activity related to points, vouchers, or pass scanning will result in immediate account termination and forfeiture of all accumulated points and rewards.

6. Cause Participation & Proof of Donation

Participating in causes (e.g., blood donation, plasma donation, CPR training, health screenings, educational quizzes) requires honest and accurate submission of proof. By submitting proof:

• You certify that the activity actually took place and that you were the participant.
• You grant Music Saves Lives the right to review, verify, and store submitted documentation.
• You understand that submitted proof may be reviewed by Music Saves Lives staff and that approval is not guaranteed.
• You acknowledge that submitting false proof may result in account suspension and legal action.

7. Donations & Payments

The Service allows you to make one-time or recurring donations to Music Saves Lives and its campaigns. Donations are processed through our third-party payment processor, Stripe. By making a donation, you agree to:

• Provide accurate and current payment information.
• Authorize the charged amount, including any applicable platform fees you elect to cover.
• Understand that donations are generally non-refundable, but refund requests may be considered on a case-by-case basis by contacting support@musicsaveslives.org.
• Manage or cancel recurring donation subscriptions through your account at any time.
• Acknowledge that donation records are retained for nonprofit accounting and tax purposes.

Music Saves Lives is a 501(c)(3) nonprofit organization. Consult your tax advisor regarding the deductibility of donations.

8. Data Sharing Consent

Certain causes or rewards may require you to consent to share your name, email, and other profile information with a partner organization or foundation. When you provide consent:

• Your data will be shared only with the specified organization for the stated purpose.
• You may withdraw consent at any time by contacting us, though data already shared prior to withdrawal cannot be recovered.
• The receiving organization's privacy policy will govern the use of your data once shared.

9. Staff & Volunteer Roles

Music Saves Lives designates certain users as staff volunteers, event staff, or staff management. If you hold a staff role, you agree to:

• Use the clock-in/clock-out system honestly and accurately for volunteer hours and shifts.
• Accept event assignments as directed by staff management.
• Not misuse staff privileges, including unauthorized access to user data or reward redemption tools.
• Understand that volunteer hours, event assignments, and any payments are tracked and retained by Music Saves Lives.

Staff roles and associated permissions may be modified or revoked at any time at Music Saves Lives' discretion.

10. User-Generated Content

By submitting content to the Service (including photos, links, advocacy posts, or profile information), you grant Music Saves Lives a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and share that content in connection with the Service and its promotional activities. You represent that:

• You own or have the rights to the content you submit.
• The content does not infringe the intellectual property or privacy rights of any third party.
• The content is not defamatory, obscene, hateful, or otherwise objectionable.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. Key points include:

• We collect personal information (name, email, address, date of birth) to manage your account and participation.
• We use your email to send transactional and promotional communications (you may opt out of promotional emails).
• We do not sell your personal information to third parties.
• Payment information is processed securely via Stripe and is not stored on our servers.
• You may request deletion of your account and data at any time by contacting support@musicsaveslives.org.

12. Third-Party Services & Links

The Service may contain links to third-party websites, services, or platforms (e.g., blood bank partners, ticketing platforms, Shopify store, social media, partner scanner pages). Music Saves Lives is not responsible for the content, privacy practices, or terms of those third-party services. Your interactions with third-party services are governed by their respective terms and policies.

13. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, images, and software, is the property of Music Saves Lives or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent from Music Saves Lives.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MUSIC SAVES LIVES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

Music Saves Lives does not provide medical advice. Information on the Service related to blood donation, plasma donation, health screenings, CPR, or other health activities is for informational purposes only and does not constitute medical advice. Always consult a qualified healthcare professional before participating in any health-related activity.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MUSIC SAVES LIVES, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, POINTS, REWARDS, DONATIONS, OR PERSONAL INJURY. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100.

16. Indemnification

You agree to indemnify and hold harmless Music Saves Lives and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

17. Account Termination

Music Saves Lives reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms or for any reason deemed necessary to protect the integrity of the Service or its users. You may also delete your own account at any time through your profile settings or by contacting us. Upon termination, all accumulated points, vouchers, passes, and rewards are forfeited.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Portland, Oregon.

19. Changes to These Terms

Music Saves Lives may update these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
